These Terms of Service ("Terms") govern your use of listess.us (the "Site") and any purchase you make through it. The Site is operated by Listess, 1040 Cowboy Mine Rd, Thermopolis, Wyoming 82443 ("Listess", "we", "us"). By using the Site or placing an order, you agree to these Terms.
Using the Site
You agree to use the Site only for lawful purposes. You may not misuse the Site, interfere with its operation, scrape it in a way that degrades performance, or use it to transmit harmful or unlawful content. We grant you a limited, revocable, non-exclusive license to access the Site for personal, non-commercial shopping use.
Products, Pricing, and Availability
We work to display products, colors, and specifications accurately, but slight variations in screen rendering and handmade or natural materials (such as bamboo grain) mean items may differ modestly from their photos. Prices are shown in U.S. dollars and exclude sales tax — we do not collect sales tax on any order. All prices, products, and availability are subject to change without notice; an order is an offer to buy, which we accept when we send the shipping confirmation. If a price was clearly displayed in error, we will contact you to confirm or cancel the affected order.
Orders and Payment
Payment is due in full at checkout through our supported payment providers. Your payment information is processed by those providers under their security terms; we never store full card numbers. You are responsible for the accuracy of the delivery address you provide — see our Shipping Policy for how address issues are handled.
Shipping and Risk of Loss
All orders ship free within the United States. Title and risk of loss pass to you upon our delivery of the package to the carrier. Delivery estimates are good-faith estimates, not guarantees.
Returns and Warranty
Our 30-day return process is described in the Return & Refund Policy. Statutory warranties apply. Beyond returns, if a product proves defective in materials or workmanship under normal household use within 12 months of purchase, contact us with your order number and photos; at our option we will repair, replace, or refund the item. This warranty does not cover misuse, accident, unauthorized modification, or normal wear.
Intellectual Property
The Site, its design, text, graphics, photographs, and the Listess name and logo are our property or used with permission, protected by U.S. and international copyright and trademark law. You may not reproduce or exploit Site content without our written consent.
Reviews and User Content
If you submit a review, photo, or other content, you grant us a non-exclusive, royalty-free license to display it in connection with our business. Content must be your own, truthful, and lawful; we may remove content that is not.
Limitation of Liability
To the maximum extent permitted by law, Listess is not liable for indirect, incidental, special, or consequential damages arising from your use of the Site or products. Our total liability for any claim is limited to the amount you paid for the order giving rise to the claim. Some states do not allow certain limitations, in which case they apply only to the fullest extent permitted.
Indemnification
You agree to indemnify Listess against claims arising from your breach of these Terms or your misuse of the Site.
Dispute Resolution and Governing Law
These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law rules. We resolve problems directly and quickly — contact support@listess.us first. Any dispute not resolved informally shall be brought in the state or federal courts located in Wyoming, and you consent to their jurisdiction. You and we each waive the right to a jury trial to the extent permitted by law.
Severability and Changes
If any provision of these Terms is unenforceable, the remainder stays in force. We may update these Terms; the "last updated" date shows the current version, and material changes will be highlighted on the Site.
